The essay initiates a comparison between labor law and civil law under the aspect of differences regarding the role of contractual autonomy, the heteronomous intervention of the law and atypical negotiations, as well as the interaction with reference to the safety obligation, to the protection of confidentiality, to the protection of the individual, in his position as a "weak contractor". This last profile, therefore, creates a cross between labor law protection and private reflection on the "asymmetry" of contractual power (also, for example, within the discipline of intellectual professions).
