The contribution deals with the controversial qualification of the logistics contract, which is the subject of a recent legislative intervention (introduction of Article 1677-bis in the Civil Code), debating whether it can be ascribed to the contractual scheme of tendering or to that of transport. The joint and several liability regime applicable in favour of the workers employed in this activity derives from this option, although this very differentiation should be eliminated in order to ensure identical protection for all 'outsourced' workers regardless of the type of contract used.
