            This work examines the nature of criminal responsibility, and thereby the very heart of criminal law theory. The analysis exposes the relevance of criminal law and punishment for the stabilization of norms within society. This allows to determine the function of placing blame and of the principle of culpability. Thus, this thesis offers in-depth insights into the mechanism and elements of the attribution of individual responsibility. The main finding is that only culpability and the consideration of its elements, which are defined in this work, are capable of functionally determining punishment (i.e., in accordance with the necessity of punishment for the stabilization of norms).
             
            Dieses Werk nimmt sich dem Wesen strafrechtlicher Schuld und damit dem Herzstück der Strafrechtstheorie an. Die Untersuchung widmet sich der Frage nach der Relevanz des Strafrechts und der Strafe für die Stabilisierung von Normen innerhalb der Gesellschaft und eruiert darauf aufbauend die Funktion des Schuldvorwurfs und des Schuldprinzips. Die Dissertation liefert dabei detaillierte Einblicke in den Mechanismus und die Elemente der strafrechtlichen Verantwortungszuschreibung. Es wird festgestellt, dass es einzig der Schuldvorwurf und die Berücksichtigung seiner in dieser Arbeit benannten Elemente vermag, die Strafe funktional zu determinieren, d.h. in Einklang mit der Notwendigkeit der Strafe für die Normstabilisierung.

            Export search results

            The export option will allow you to export the current search results of the entered query to a file. Differen formats are available for download. To export the items, click on the button corresponding with the preferred download format.

            A logged-in user can export up to 15000 items. If you're not logged in, you can export no more than 500 items.

            To select a subset of the search results, click "Selective Export" button and make a selection of the items you want to export. The amount of items that can be exported at once is similarly restricted as the full export.

            After making a selection, click one of the export format buttons. The amount of items that will be exported is indicated in the bubble next to export format.
